Electres (a business unit of tecHindustan Solutions Private Limited, having its registered office at ITC 11, 3rd Floor, Sector 67, Mohali, Punjab — 160062, India) (“Electres“, “Company“, “we“, “us“, or “our“) is committed to protecting the privacy of individuals whose personal data we collect, use, and process in connection with the Electres website www.electres.com (the “Website“) and our products and services.

This Privacy Policy explains what personal data we collect, how we use it, with whom we share it, your rights, and how to contact us. It applies to all visitors, customers, prospective customers, partners, suppliers, job applicants, and other individuals who interact with us.

This Privacy Policy is published in accordance with the Digital Personal Data Protection Act, 2023 of India and the Information Technology Act, 2000 and rules made thereunder, and reflects our practices as the Data Fiduciary in relation to your personal data.

• “Processing” means any operation performed on Personal Data, including collection, recording, organization, storage, use, disclosure, transfer, or deletion.

   • Communication content — emails, WhatsApp messages, support tickets, and call recordings (where notified) when you communicate with us.
   • Recruitment information when you apply for a role — CV, cover letter, references, employment history, education, and assessment responses.
   • Partner and supplier information when you engage with us as a dealer, EPC, or supplier — business credentials, financial details (as needed for vendor onboarding), and authorized signatories.

2. Information collected automatically

   • Device and usage information — IP address, browser type and version, operating system, device identifiers, referring URL, pages visited, time spent, and click patterns.
   • Cookies and similar technologies — see Section 8 below.

3. Information from third parties

   • Referrals and introductions — when a partner, dealer, or referrer shares your contact information with us with your prior consent.
   • Publicly available information — for example, business contact information from LinkedIn or company websites, used for outreach and prospecting in a B2B context.

3. How We Use Your Personal Data

We process your Personal Data for the following purposes, on the basis of your consent or other lawful grounds as recognized under the DPDP Act:

1. To respond to your inquiries, requests for quotations, or contact form submissions;
2. To provide and deliver products and services you have purchased, including installation, commissioning, service, and warranty support;
3. To process and manage purchase orders, invoices, payments, and statutory documentation;
4. To communicate with you regarding orders, deliveries, service, product updates, recalls, safety notices, and regulatory matters;
5. To send marketing communications about Electres products and services, where you have provided consent or where permitted under applicable law (with an option to opt out);
6. To evaluate your application for employment (where you have applied for a role);
7. To onboard and manage relationships with dealers, EPCs, partners, and suppliers;
8. To improve our products, services, Website, and customer experience;
9. To comply with legal, regulatory, accounting, tax, and reporting obligations;
10. To prevent, investigate, and respond to fraud, security threats, and unlawful activity;
11. To establish, exercise, or defend legal claims;
12. For any other purpose with your specific consent.

4. Legal Basis for Processing

We process your Personal Data on one or more of the following legal bases, as recognized under the DPDP Act, 2023:

1. Consent — where you have given specific, informed, and unambiguous consent;
2. Legitimate use — for purposes specifically permitted under the DPDP Act, including:
   • Where you have voluntarily provided Personal Data for a specified purpose and have not indicated objection;
   • For employment-related purposes;
   • For compliance with any judgment, order, or regulatory requirement under Indian law;
   • For responding to medical emergencies or safety threats;
3. Performance of contract — Voluntary provision of Personal Data for fulfillment of requested products, services, transactions, installations, support, or contractual obligations;
4. Legal obligation — where processing is required to comply with applicable law.

5. Sharing and Disclosure

We do not sell your Personal Data. We share your Personal Data only as described below:

1. With service providers and processors

   We engage third parties to provide services on our behalf — including cloud hosting, customer relationship management, email and communication, payment processing, shipping and logistics, installation contractors, accounting, and legal advisors. These third parties process Personal Data on our instructions, under appropriate contractual safeguards, and only as necessary to perform the relevant service.

2. With our group company

   As Electres is a business unit of tecHindustan Solutions Private Limited, your Personal Data may be accessed and processed by other functions within tecHindustan (such as HR, IT, Finance, Legal) that provide shared services to the Electres business unit.

3. With business partners

   We may share Personal Data with our authorized dealers, EPCs, installers, and service partners where necessary to fulfill your purchase, installation, or service request — with your consent or as required to perform our contract with you.

4. With suppliers

   In limited cases, technical information (without unnecessary personal identifiers) about installations may be shared with our component suppliers for warranty processing, technical investigation, or product improvement.

5. In a business transaction

   In the event of a merger, acquisition, restructuring, sale of business, financing transaction, or due diligence in relation to any of the foregoing — including, in particular, the planned spin-out of Electres into a separate legal entity — your Personal Data may be transferred to the relevant counterparty or successor entity, subject to confidentiality undertakings and the protections of applicable law.

6. Legal disclosures

   We may disclose Personal Data when required to:

   1. Comply with applicable law, court order, subpoena, or government investigation;
   2. Enforce our Terms and Conditions or other agreements;
   3. Protect the rights, property, or safety of Electres, our customers, or others;
   4. Respond to claims of unlawful activity or violation of third-party rights.

6. Cross-Border Transfers

If your Personal Data is transferred outside India — for example, to cloud hosting providers, email service providers, or technical suppliers based abroad — such transfers will be made only to countries that are not restricted under the DPDP Act and subject to appropriate safeguards.

7. Data Retention

We retain your Personal Data only for as long as necessary to fulfill the purposes for which it was collected, including:

• Customer data: for the duration of the customer relationship plus the period required to enforce or respond to warranty, service, regulatory, tax, accounting, and legal obligations — typically 8 years after the end of the warranty period.
• Prospective customer data: typically up to 3 years from last interaction, after which we will delete or anonymize unless an active relationship continues.
• Job applicant data: typically up to 1 year from the date of the application, after which we will delete unless you have consented to longer retention for future consideration.
• Partner and supplier data: for the duration of the engagement plus 8 years.
• Website analytics data: generally up to 26 months.

We may retain Personal Data for longer periods where required by law (such as for tax, accounting, or regulatory compliance), or where necessary to establish, exercise, or defend legal claims.

8. Cookies and Similar Technologies

The Website uses cookies and similar tracking technologies to:

• Measure the effectiveness of our marketing.

2. Right to correction and erasure — to seek correction of inaccurate or misleading data, completion of incomplete data, and erasure of Personal Data that is no longer necessary for the purpose for which it was processed;
3. Right to grievance redressal — to raise grievances with our designated Grievance Officer (see Section 11);
4. Right to nominate — to nominate another individual who shall exercise these rights in the event of your death or incapacity;
5. Right to withdraw consent — to withdraw your consent at any time. Withdrawal will not affect the lawfulness of processing carried out before the withdrawal, and may affect our ability to provide certain products and services to you.

We will respond to your request within the timelines required by applicable law (typically 30 days, extendable in limited circumstances).

We may need to verify your identity before processing your request, to protect your data from unauthorized access.

10. Security

We implement reasonable security safeguards designed to protect Personal Data from unauthorized access, disclosure, alteration, or destruction. These include administrative, technical, and physical safeguards appropriate to the nature of the data we process.

However, no system can be guaranteed to be completely secure. In the event of a Personal Data breach, we will notify the Data Protection Board of India and affected individuals as required under the DPDP Act.

In accordance with the DPDP Act, 2023 and the Information Technology Act, 2000, we have designated a Grievance Officer to address concerns and complaints regarding the processing of your Personal Data:

12. Children’s Data

The Website and our products are not directed at children below 18 years of age. We do not knowingly collect Personal Data from children. If you believe we have collected data of a child, please contact the Grievance Officer and we will take steps to delete it.

For any processing of children’s data (e.g., where a parent purchases an Electres Home for their household and a child uses the system), we do not knowingly collect or process Personal Data of children

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or business operations. The updated policy will be posted on the Website with the “Last updated” date revised. We encourage you to review this Policy periodically.

For material changes that affect your rights or how we use your Personal Data, we will provide additional notice (such as via email or a prominent Website notice) where required by law.
